NBLO Senior Associate Publishes in the Journal of the Supreme Bar Council of Bulgaria

Senior Associate Yavor Markov of New Balkans Law Office has authored a publication in Адвокатски преглед (Advokatski Pregled), the journal of the Supreme Bar Council of Bulgaria.

The paper analyses Bulgarian case-law concerning Article 52(1) of the Charter of Fundamental Rights of the European Union, which sets out the conditions under which fundamental rights may be limited. It reviews approximately 85 judicial acts that explicitly refer to this provision and examines whether Bulgarian courts have applied the legality test developed in the case-law of the Court of Justice of the European Union.

The analysis concludes that, while the reasoning of Bulgarian courts does not always explore the legality test in full detail, the resulting judgments generally comply with the principles of legality and proportionality required under Article 52(1).

Mr Markov’s contribution highlights the growing engagement of Bulgarian courts with EU fundamental rights standards and provides a useful reference for practitioners and scholars in the field of EU and constitutional law.
