Since Bulgaria’s full participation in the European Union and the Schengen Area, interest in clarifying and restoring Bulgarian citizenship status has increased significantly.

Apart from acquisition of citizenship by origin, Bulgarian law also provides a separate administrative procedure for the establishment (verification) of Bulgarian citizenship. This procedure applies to individuals who were already Bulgarian citizens but have left Bulgaria and for a prolonged period have not maintained or renewed their Bulgarian identity documents.

Legal Framework

The establishment procedure is governed by the following legal instruments:

  • Bulgarian Citizenship Act – regulates the status of Bulgarian citizenship and the conditions under which it is retained, lost, or verified.
  • Administrative Procedure Code – governs the administrative proceedings before the competent authority.

The Ministry of Justice of Bulgaria is the competent authority responsible for examining applications and issuing an official certificate confirming whether a person is or is not a Bulgarian citizen.

Unlike procedures for acquisition or restoration, this process does not result in a presidential decree. Instead, it concludes with the issuance of an official certificate confirming citizenship status.

Eligibility Criteria

This procedure may be used by:

  • Persons born in Bulgaria who became Bulgarian citizens by birth, regardless of their ethnic origin;
  • Persons who acquired Bulgarian citizenship on another legal ground (naturalisation, marriage, etc.);
  • Their direct descendants, where the issue concerns the clarification of inherited citizenship status.

In order to qualify under this procedure, it must be established that the individual:

  • Has not formally renounced Bulgarian citizenship; and
  • Has not lost Bulgarian citizenship pursuant to an applicable international treaty or specific statutory provision.

Importantly, ethnicity is legally irrelevant in this procedure. A person may belong to any ethnic community in Bulgaria – including Turkish, Jewish, Armenian, or others.

Issuance of Certificate

After reviewing all relevant circumstances and documents, the Ministry of Justice issues an official certificate confirming whether the person is or is not a Bulgarian citizen.

It is essential to note that:

  • The certificate does not grant citizenship. It officially certifies an already existing (or non-existing) legal status;
  • The certificate is valid for one year from the date of issuance.

If the certificate confirms Bulgarian citizenship, the individual may proceed to apply for Bulgarian identity documents.

Practical Aspects

When initiating this procedure, applicants should carefully gather archival and civil registry documentation. Verify whether any formal renunciation of citizenship occurred. Confirm whether international agreements may have affected citizenship status. Ensure all foreign documents are properly legalised and translated.

Because citizenship laws have changed multiple times throughout the 20th century, legal analysis of historical legislation is often necessary.

The establishment of Bulgarian citizenship is a distinct legal procedure aimed at clarifying an already existing citizenship status, rather than acquiring new citizenship.
