Legal services to clients involved in the Bulgarian Market
As part of our general interest in maximising the potential that EU law has for both our international and domestic clients, we devote special attention to developing our competition/regulatory compliance practice. We are able to advise on concentrations (including mergers and acquisitions) in the context of pre-acquisition consultancy and perform legal due diligence in the course of the transaction. We have a particularly strong capacity in a number of niche areas of Bulgarian competition law with extensive experience in deals with a regulatory as well as an anti-trust aspect. We are also well suited to deal with matters involving a complex interface between competition and intellectual property laws.
In anticipation of Bulgaria's accession to the European Union in 2007, but especially so after the accession, business practice in Bulgaria began to incorporate strong elements of EU law, an area which we have solid experience in. We find that the EU acquis and the judicious use of the EU institutions and procedures can be of considerable help to our clients and where appropriate we will advise on the use of such instruments and will provide representation in front of the Commission and the Bulgarian government if necessary. In this regard, we have successful experience bringing directly applicable EU law to bear on various institutions in regulatory, administrative and civil procedure contexts.
Our legal experience in the energy and renewables sector is wide ranging and related to the diverse nature and the modern development of these spheres. We have the expertise to deliver full scope legal assistance to clients interested in investing in the energy and renewable resources sector in Bulgaria. We advise on the effective structuring, development, financing and implementation of a variety of energy projects and we help our clients with all legal aspects of energy project management from the planning stage through to financial close and beyond to encourage future expansions and restructurings. We can offer advice on the various aspects and implications of the energy regulatory framework as well as advice on other legal issues such as environmental regulations, protection of competition, public procurement and consumer protection. We have worked on a wide variety of matters concerning the healthcare/pharmaceutical sectors in Bulgaria, with most of this work being regulatory in nature (such as advising on the framework and procedures for obtaining marketing authorisation for medicinal products under the recently-introduced Pharmaceuticals Act and accompanying representation before the Bulgarian Drug Agency). There is often somewhat of an overlap with our competition work here since we advise on parallel importation and export, R&D and the conduct of clinical trials, pricing agreements and mergers within the sector. We also provide a range of legal services concerning healthcare/pharmaceutical intellectual property rights, with advice being given not only on patents and trade mark filing but also on I.P. Litigation, for which we also offer representation in relevant hearings.
We offer commercially-tailored advice on licensing exploitation which usually involves reviewing and negotiating licensing agreements, research and development contracts, confidentiality agreements and supply and distribution contracts.
We provide advice on all legal issues arising from public procurement procedures and are willing to provide legal advice on both large and small public contracts.
